an interested part of this story as to why WK is probably being preemptive:
Wizards reportedly contacted WizKids in 2004 giving notice that it had applied for the patent for a punch-out constructible game and suggesting strongly that, when and if the patent were granted, WotC would take action against WizKids unless the latter would refrain from producing, marketing and selling its Pirates CSG.
Also this article makes mention of wizards CCG patent which Fell and I were discussing last week, apparently Wizards has been very unsuccessful in enforcing it in most cases which pretty much means it's a worthless patent since Wizards hasn't been diligent in enforcing it.

Interesting. Has WotC actually developed a constructible game, or did they just develop the technology? I always thought it was a WizKids original.

They have the Transformers CSG, but that's the only one I know of.
